,ORONO REGULAR COUNCIL MEETING HELD OCTOBER 8, 1990 <br />#1532 FULLERTON PROPERTIES, INC. <br />•2225 SIXTH AVENUE NORTH <br />ROAD NAME APPROVAL <br />FINAL SUBDIVISION OF PROPERTY <br />RESOLUTION #2880 <br />Mr. Joe Franks, Vice President of Fullerton Properties, <br />Inc. was present for the review of this application. <br />It was moved by Acting Mayor Callahan, seconded by <br />Councilmember Nettles, to adopt Resolution #2880 approving the <br />road names of Cox Farm Road and Shadowood Drive. Motion, Ayes -4, <br />Nays -0, Motion passed. <br />City Administrator Bernhardson explained that the other <br />portion for consideration of final subdivision is the issue <br />relating to contingency on the easement being granted over the <br />drainage and utility easements for a bike trail. The application <br />for this property was originally filed prior to new Park <br />Dedication Fees going into effect. $200.00 for each lot was to <br />go to City. After discussions, the City found the drainage and <br />utility areas amenable to bike trails and the applicant indicated <br />a willingness to allow trails under certain conditions. The <br />developer would like no construction on this drainage and utility <br />easement until such time as the City has acquired and is <br />constructing a trail of equal length connecting to this property. <br />The Park Commission reviewed this condition and it is their <br />recommendation that this contingency not be included. Staff sees <br />• that the proposal by the developer is not out of line with the <br />development. The City will look at a proposal with all the bike <br />trails, indicate where easements and property are availabe to <br />construct trails, get quotations, study the budget of park <br />dedication and come up with a proposal for constructing a trail <br />in increments. This should help solve this impediment. <br />Acting Mayor Callahan asked for clarification of "take and <br />give back ". Bernhardson explained this is a separate issue that <br />entails right -of -way dedication on the western boundary of this <br />property exluding the Jim Cox parcel for the Outlots. This has <br />been used as a yard by Mr. Cox over the years. The City asked <br />for additional right -of -way dedication as part of this plat. Mr. <br />Cox was concerned about this. There is a possibility that Willow <br />Drive, if it is ever reconstructed probably by the County, would <br />be moved to the west so that the additional 7' right -of -way would <br />possibly not be needed. It was originally proposed that the City <br />would automatically grant that back to property owner if not <br />needed. However, because of various laws regarding vacation of <br />roads, the proposal now is that the City would only, at his <br />request, set up the necessary vacation hearings to possibly allow <br />that to happen. <br />Joe Franks addressed the Council. He reviewed the July 9, <br />1990 meeting at which time the Council granted the preliminary <br />plat approval and issued a resolution with some 15 compliance <br />• <br />C <br />
