VOTE: Ayes 5, Nays 0. <br />PLANNING DEPARTMENT REPORT — REPRESENTATIVE BRUCE LEMKE <br />14. #15-3763116-3860 CHRISTOPHER AND GAIL BOLLIS/CHRISTOPHER AND RACHEL <br />BOLLIS, 200-350 STUBBS BAY ROAD NORTH -FINAL PLAT APPROVAL — RESOLUTION <br />NO. 6708 <br />Senior Planner Gaffron stated on September 14, 2015, the City Council adopted a resolution granting <br />preliminary plat approval for a 7 -lot plat of the properties located at 200-350 Stubbs Bay Road. Since <br />that time the developer has submitted a variety of documents. The applicants have completed the <br />agreement with the neighborhood to the south. In that agreement the applicants are proposing to extend <br />the private road from the end of Kintyre Lane near the end of Watertown Road. In addition, the <br />development agreement will require that all access for road construction be from Stubbs Bay Road. <br />Further, the little wobble in one section of the road has been removed in order to straighten it out and the <br />developer will be moving a house and some trees in there. The City Council is also looking at a septic <br />system agreement for the septic system located on Lots 4 and 5 where the septic system is currently <br />located over a lot line. <br />Gaffron stated the applicants are proposing to grade building pads into certain lots, creating new <br />engineered grades to establish existing ground levels for individual building purposes. <br />The private road in Outlot B is subject to private easement and maintenance covenants as well as an <br />underlying access easement to the City. An easement for public access is not being granted, which makes <br />this truly a private road. Staff and the City Attorney feel there is minimal, if any risk, to not requiring an <br />underlying public easement when certain conditions exist. Those conditions exist in this situation and <br />include the following: <br />The private road being created does not have the potential to be extended to serve adjacent <br />undeveloped properties. <br />2. The developer has established covenants that require homeowner maintenance of the private road <br />yet allow the City to provide for maintenance if the homeowners do not do so, and to assess the <br />homeowners for that work. <br />Page 11 of 33 <br />
