Further water and ice forms in a <br /> section 10'wide from the asphalt and should not collect along the sidewalk throughout the winter and <br /> early spring.The design doesn't accommodate the seasonal freezing and thawing. <br /> East side drainage(see pictures): The East side of our property is flat to sloped towards our house and <br /> towards the lake such that the water is flowing through our retaining wall and into the Southwest corner <br /> of the foundation. We are sure to have a "washout"within a relatively short time. Furthermore, it <br /> appears that the West side of the Bergstrom property,their roof, and driveway is draining on to our <br /> property. The drainage of water should not be coming from the Bergstrom property on to ours to the <br /> extent that it has been draining. Ultimately,this condition combined with the drainage issues on our <br /> property presents an even worse scenario for our retaining wall and basement flooding.This condition is <br /> not only damaging the retaining wall but wetting and warping the siding and door.This condition needs <br /> to be remedied including the replacement of the lower garage door. It is my understanding that <br /> concurrent with the permits to build the Bergstrom house, LDK was notified of the potential drainage <br /> problem by the city planners/engineers. <br /> We expect to continue to work with Jay on various warrantee items which we have and continue to <br /> summarize for him. In addition however,we would like to see a plan and implememtation schedule that <br /> rectififies the drainage issues for our property and the Bergstrom property, (to the extent that it affects <br /> our property) before LDK completes the driveway and additional work on the Bergstrom property. <br /> Thank you and please contact Linda or me with any questions. <br /> Very truly yours, <br /> Darrell and Linda Tamosuinas <br />
