O O CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> �, G~ NO. 6 2 1 3 <br /> SH0 <br /> f. The proposed on-site borrow area shown to the south of the wetland is <br /> shown to be graded to the same contour as the Wetland and seeded with <br /> buffer vegetation. Because of its proximity to the Wetland, the wetland <br /> vegetation will migrate to this area, and it will most likely become a low grade <br /> wetland in the future. The area will still provide the same stormwater <br /> treatment and rate control as originally proposed. <br /> g. The mitigation provided by the borrow area results in a minimization of the <br /> proposed impacts from an original 0.71 acres to 0.42 acres. The proposed <br /> plan proposes an additional 12,181 square feet of native buffer above the <br /> minimum required. <br /> h. The MCWD Board would be reviewing the application for placement of fill <br /> within the Wetland and a variance to the MCWD requirement for on-site <br /> mitigation at a meeting to be held on March 28, 2013. This application was <br /> reviewed as MCWD application number 12-348. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the Applicant, the conditional approval of MCWD application number 12-348 <br /> by the MCWD Board, and comments from the public, as well as the effect of the <br /> proposed conditional use on the health, safety and welfare of the community as <br /> well as the impact on properties in the vicinity. <br /> 6. The City Council finds that the wetland alteration is in accord with the objectives <br /> of the RR-1B zoning district in which the Property is located and with the <br /> comprehensive municipal plan and that the wetland alteration will not be <br /> detrimental to the public health, safety or welfare, or materially injurious to <br /> properties or improvements in the vicinity. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> approval pursuant to Orono Municipal Zoning Code Section 78-1609 for a CUP for wetland <br /> alteration in order to fill in portions of the Wetland, subject to the following conditions: <br /> 1. Council approval is based on the Plans submitted by the Applicant and annotated by <br /> City staff, attached to this Resolution as Exhibits A through E: Any amendments to the <br /> Plans which are not in conformity with City codes will require further Planning <br /> Commission and City Council review. <br /> Page 3 of 5 <br />
