Syc.13.04 RIGHTS OFSUBJECTS OFDATA Subdrvrsion 1. Type ojdata The rights of i»dividual on whom the data is stored or to be stored shall be as set forth in this section. Subd.2. Injormation required to be given individuaL An irrdividual asked to supply private or confidential data concerning himselj shall be informed of.• (aJ the purpose and ixtended use of the requested data within the collecting state agency,polrtical subdivision,or statewide system;(6)whether he may refuse or is legally sequired to supply the requested data;(c)arry known consequence arising from his supplying or refusing to supply private or confidential data;arul(d)the identiry of o�her persons or entities authorrzed by state orfederal law to receive the data. This requirement shall not apply when an individual is asked to supply irrvestigative data,pursuant to section 13.82,subdivision S,�to a law enforcement o�cer. The commissioner of reverrue mav nlace the notice reouired under this subdivision in the individual income tax or nropertv tax refund instructions instead ofon those forms. Subd.3.Access to data by indivtdtiaL Upon request to a responsible authority,an indtvidual shall be informed whether he rs the subject of stored data on individuals,and whether it is class�ed as public,private or confrdential. Upon his further request,an individual who is the subject of stored private or public data on individuals shall be shown the data without arry charge to him and,if he desrres,shall be informed oJ the content and meaning of that data. After an individua!has been shown the private data and informed of its meaning,the data need not be disclosed to him for six months thereafter unless a dispr�te or action pursuant to thrs section is pending or additiona!data on the individual has been collected or created. The responsible authority shall provide copies of the private or publtc data upon request by the indrvidual subject of the daJa. The responsible authority may requrre the requesting person to pay�he actua!costs of makixg,cert�ing,and compiling the copies. The responsible authority shall comply immediately,rfpossible,wilh arry request made puntuan!ro thrs subdivision,or within five days of the date of the reques�,excluding Saturdays,Suxdays and lega/holydays,if immediate compliance is not possible. I,f he caxnot comply with the request witAin that time,he shall so inform the individual,and may have an additional frve days within which to comply with the request,excludrng Saturdays,Sundays and legal holidays. Subd.4.Procedure when data is not accurate or complete An individual may contest the accuracy or completeness ofpublic or private data concerning himself. To exercise thrs right, an irtdividual shall not�in writing the responsible authority describing the nature of the drsagreemenr. The responsible authority shall within 30 days either: (a)correct the datafound to be irraccurate or incompleJe and attempt to not� past recipients of inaccurate or incomplete data,including recipients named by the individual;or(b)not�the individual that he believes rhe data to be conect. Data in drspute shall be disclosed only if 1he individual's statement of disagreement is included with the disclosed data. The determination of Jhe responsible authority may be appealed pursuant to the provrsions of the adminrstrative procedure act relating to contested cases.
