(a) The front 50 feet, rear 50 feet and side 40 feet of Lots <br /> 1 through 4 of Block 1; and <br /> � (b) The front 50 feet, rear 50 feet and side 30 feet of all <br /> other lots in Blocks 1, 2 , 3 and 4 . <br /> 5. "City" shall mean the City of Orono, a Minnesota municipal <br /> corporation. <br /> 6. "Common Area" shall mean all real property (including any <br /> improvements thereon) owned by the Association for the common use <br /> and enjoyment of the Owners. The Common Area to be owned by the <br /> Association at the time of the conveyance of the first Lot is <br /> legally described as Outlots A, B and C, SUGAR WOODS, Hennepin <br /> County, Minnesota. <br /> 7. "Declarant" shall mean Rebers Construction Co. , a <br /> Minnesota corporation, its successors and assigns, if such suc- <br /> cessors or assigns should acquire more than one undeveloped Lot <br /> from the Declarant for the purpose of development. <br /> 8. "FNMA" means Federal National Mortgage Association. <br /> 9. "Lot" shall mean any parcel of land shown upon any <br /> recorded plat of the Properties, except for the Common Area. <br /> 10. "Member" shall mean the Owner of a Lot in its capacity <br /> as a member of the Association. <br /> il. "Owner" shall mean the record owner, whether one or more <br /> persons or entities, of fee simple title to any Lot which is a part <br /> of the Properties. However, if a Lot is being sold by a recorded <br /> contract for deed, then the contract vendee shall be deemed the <br /> "Owner" rather than the contract vendor. <br /> 12 . "Private Woodland Preserve" means Outlots A and B, SUGAR <br /> WOODS and those portions of Outlot C, SUGAR WOODS that are not <br /> improved with Sugarwoods Drive. <br /> 13 . "Properties" shall mean the real property in the City of <br /> Orono, County of Hennepin, State of Minnesota, legally described <br /> as follows: <br /> Lots 1 through 6, Block 1; <br /> Lots 1 through 6, Block 2; <br /> Lots 1 through 5, Block 3; <br /> Lots 1 through 8, Block 4 ; and <br /> Outlots A, B and C; <br /> all in SUGAR WOODS, according to the recorded plat <br /> thereof. <br /> 2 <br />
