Those involving the use or parking of a commercial or nonpassenger vehicle, whether such use or parking is in a building or outside. The applicant's business involves the use of commercia/or nonpassenger vehicles. 4. Those which do not meet one or more of the specified performance standards. The applicants'business does not meet one or more of the performance standards within Section 78-1376(d). 5. Those which generate excessive traffic under the standards of subsection (d)(13) of this section. The applicant's business generates excess traffic within the neighborhood. Home occupations are subject to sixteen performance standards. It appears to staff that the applicant is unable to meet two of the performance standards (standards 6 and 8 as listed below). (6) Outdoor storage prohibited. Outdoor storage or display of materials, goods, supplies or equipment related to the conduct of the home occupation shall be prohibited, except that licensed passenger vehicles used in the home occupation may be parked outside provided they are in compliance with all other requirements of this section. Planning Staff Recommendation Planning staff believes that the level and type of activity of this courier business as it is currently being operated falls into the category of a prohibited use and should be discontinued within this residential neighborhood. COUNCIL ACTION REQUESTED Council is requested to review the information and make a determination as to whether the applicanYs business qualifies as a Level 2 or is prohibited. Should the Council determine that the business qualifies as a Level 2 home occupation, additional appropriate performance standards or conditions should be considered. 2
