�O,� LEVEL 2 HOME OCCUPATION LICENSE <br /> O O GRANTED TO GARY FRAZIER <br /> a FOR <br /> � ��' EXPRESS DELIVERY SYSTEMS <br /> ��0$,4► <br /> WHEREAS, Gary Frazier is the owner of Express Delivery Systems, a courier business, <br /> operated from his residence at 4555 Spruce Way; <br /> WHEREAS, on July 30, 2009, Gary Frazier submitted a Level 2 Home Occupation <br /> License Application; <br /> WHEREAS, the home occupation consists of two, non-passenger vehicles or "straight <br /> trucks" and two employees who reside at 4555 Spruce Way; <br /> WHEREAS, the Orono City Council held a Public Hearing on August 24, 2009 to review <br /> the Level 2 Home Occupation License request for Express Delivery Systems; <br /> WHEREAS, the adjacent neighborhoods along Spruce Way and the north end of <br /> Townline Road are just beginning to develop; currently the potential impacts of the home occupation <br /> are minimal due to the lack of residential development within the immediate neighborhood; and <br /> WHEREAS, on August 24, 2009, the Orono City Council granted approval of the Level 2 <br /> Home Occupation License for Express Delivery Systems with certain conditions. <br /> NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council approves the <br /> Level 2 Home Occupation application of Gary Frazier, owner of Express Delivery Systems, at <br /> 4555 Spruce Way with the following conditions. <br /> 1. The business is limited to two (2) single axel, "straight trucks" not to exceed 26,000 GVW; <br /> 2. The vehicles associated with the business are to be stored in an enclosed building by <br /> August 24, 2010; <br /> 3. The vehicles may be replaced with a similar vehicle if necessary; <br /> 4. No freight may be brought to site; <br /> 5. Trucks must be empty and comply with vehicle road weight restrictions; <br /> 6. Each truck is limited to one (1) round trip from the address per day; <br /> 7. An increase in density of residential homes on Spruce Way and/or Townline Road may <br /> trigger a review of the license; <br /> 8.
