The applicants' property is 0.47 acres in total area and has 61' of width <br /> at the shoreline and 125' at the 75' setback from the OHWL of Lake <br /> Minnetonlca. No additional land is available to make the property <br /> nearer confoimity as to area or width. <br /> b. The existing stair�vithiil the 0-75' zone will remain. <br /> c. The boat house within the 0-75' zone will be removed during the <br /> winter of 2006 at such time when access can be gained from the lake <br /> so as to avoid damage to the lake yard of the property. <br /> d. The proposed home will meet all setback, hardcover, and lot covera�e <br /> requirements. <br /> e. The site regrading in the 0-75' zone after home and boathouse removal <br /> is necessary in order to restore the site to appropriate grades. <br /> 4. The City Council has considered this application including the findings <br /> and recominendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> variances and conditional use permit on the health, safety and welfare of <br /> the community. <br /> 5. The City Council finds that the conditions existinJ on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance and conditional use permit would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard or otl�er <br /> danger to neighboring property; would not merely serve as a convenience <br /> to the applicants, but is necessary to alleviate a demonstrable hardship or <br /> difficulty; is necessary to preserve a substantial property right of the <br /> applicants; and would be in lceeping with the spirit and intent of the <br /> Zonin� Code and Comprehensive Plan of the City. <br /> CONCLiJSIONS, O�I2�R AN1D CONDI'I'I+�NS <br /> Based upon one or more of the above findin�s, tile Orono City Co�ulcil hereby <br /> �rants lot ���idth and lot area variances and conditional use perniit to Orono Municipal <br /> Z017111Q Code Sections 78-330(Bj and Section 78-1286 to allo�v construction of a new <br /> sinale family residence on a lot 0.47 acre in area and has 61' of width at the shoreline and <br /> Pa�e ? of� <br />
