E� � � � . <br /> S <br /> NOW, THEREFORE BE IT RESOLVED, that the petition of W. Wyatt Moe and <br /> Nancy Moe is hereby granted and that the described portions of dedicated right-of-way and <br /> park within the plat of saga Hill Revised, Hennepin County, Minnesota are hereby vacated. <br /> The granting of this petition is subject to the following conditions: <br /> 1. Upon vacation, applicants shall combine the respective vacated adjacent portions <br /> of park and right-of-way with the respective portions of Lots 3,4 and 5, Block <br /> 2, saga Hill revised, per the survey attached hereto as Exhibit B, to wit: <br /> a. Pazcel E shall be combined with Parcels A & G. <br /> b. Pazcel F shall be combined with Parcels B & D. � <br /> 2. Upon vacation, applicants shall quit-claim deed to the City the portion of Lot <br /> 5, Block 2, Saga Hill Revised and portion of vacated Portland Place identified <br /> on Exhibit B as Pazcel C. <br /> • r_ <br /> 3. Applicants shall grant to the City a drainage easement over the drainageways � <br /> shown on Exhibit B, such drainage easements each to be 15' in total width, 7.5' <br /> either side of the defined centerlines. The applicant shall provide a legal <br /> description for said easements. <br /> 4. Applicants shall grant to the City an easement for sanitary sewer lines which are <br /> believed to be located within Parcels A, G, B, D and/or F. The City shall <br /> provide a legal description for said easements. <br /> 5. Applicant shall grant any easements deemed necessary for existing utilities within <br /> Parcels A, B, D, E, F and G if such utilities are subsequently identified. <br /> Adopted by the City Council of the City of Orono, Minnesota at a regular <br /> meeting held this 25th day of August, 1997. <br /> ATTEST: <br /> • Page 2 of 3 <br />
