� Sec.13.04 RIGHTS OFSUBIECTS OFDATA ' ' Subdivision 1. Type ojdnta The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd 2. Info��rmtlon requlred to be given individuaL An individual asked to supply private or confrden�ial data concerning himse f shall be informed of (o)!he purpose and intended use of the requested data withrn�he collectrng slate agency,politica!subdivrsion,or statewide system;(b)whether he may refuse or is legally required to supply the requesJed dala;(c)a�ry known consequence arising from his supplying or refustng to supply prrvate or confidential data;and(d)the identity oJother persons or entities authorized by state or federallaw to receive the data. ThLs�equirement shall not apply when an individual is asked to supply imestigative data,pursuant to section 13.82, subdivisron 5, to a law enfo�cement offrcer. Subd.3.Access to data by 7ndivtduaL Upon request to a responsible authority,an individual shallbe informed whelher he is the subject of stored data on rndividuals,and whether it is classifred as public,privale or conftdential. Upon his further request,an indivrdual who rs the subject ojslored privale or pub/ic data on indivfduals sha/l be shown the data without arry charge to him ared,if he desires,shall be informed of the content and meaning of that data. Ajter ax indivrdual has been shown the private data and rnformed of rts meaning,the data need not be disc%sed to him for six months thereafter unless a drspute or action pursuan�to this section is pending or additional data on the individual has been collected or created. The responsible authority shall provide copies of the private or public dato uporr request by the indrvidua!su6ject of the data. The�esponsible authority may require the requestrng person to pay the actual costs of making,cert�rng,and compi[ing the copies. The respansible authority shall comply immediately,if possible,with mry request made pursuant to thrs subdivisron,or withinfrve days of Jhe date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the request within that time,he shall so rnform the individual,and may have an additional frve days wrthrn which to comply with the request,excludrng Saturdays,Sundays and legal holydays. Subd.4.Procedure when data is not accurate or complet�An indivrdual may contest the accuracy or completeness ofpublic or private data concerning himself. To exercise this right, an individual shal/not�in writing�he responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a)correcJ the data found to be inaccurate or rncomplete and attempt to not� past recrpients of inaccurate or incomplete data,includingreciprents named by the individual;or(b)not�the rndividual that he believes the data to be correct. Data ix dispute shall be disclosed only if the individual's slatement of disagreement is included with the disclosed data. The determination of the responsible authority may be appea/ed pursuant to the provisioru of the administrative procedure act relating to contested cases.
