The survey submitted is not to <br /> scale and does not reflect all existing hardcover on the property. Even though the property is not located in a <br /> Stormwater Quality Overlay District,the property should accurately reflect all existing buildings, structures, landscaping <br /> and retaining walls,as indicated on our survey requirements, copy attached. Please have the survey updated and <br /> submit two full-size, scalable copies so we can continue our review. <br /> Also, Rich,you inquired if the abutting property(PIN 02-117-23-21-0018) is a buildable lot. The PIN 02-117-23-21-0018 <br /> is also located in RR-1B zoning district which requires 50'front and rear setbacks and 30'side yard setbacks. According <br /> to City Code Section 78-72(b)(1), Lots of Record (see below),the lot is not eligible for administrative approval;a number <br /> of variances would be necessary to build. Further,the deck being proposed or the existing house will not meet the <br /> required sideyard setback of 30' if the PIN 02-117-23-21-0018 is not included in the setback measurements. <br /> To simplify the PIN 02-117-23-21-0018 could be combined with the property addressed 145 Smith Avenue. The City can <br /> request Hennepin County to combine the two PINs into one PfN. We will need written request from the property owner <br /> and a copy of the deeds for each PIN. <br /> If you are going to pursue a variance to attempt to build on PIN 02-117-23-21-0018 the deck permit will not be allowed <br /> because it will not meet the sideyard setback. You should set up an appointment with stafF to discuss. A variance <br /> application fee is$700 and it is non-refundable. A variance request requires Planning Commission and Council <br /> approval...usually about 2%: month process. <br /> If you have any questions, please don't hesitate to contact me or Melanie. <br /> Sec. 78-72. - Lots of record. <br /> (a) A lot of record is any lot for which a deed or registered land survey has been recorded in the office of <br /> the Register of Deeds or the Registrar of Titles for Hennepin County prior to January 1, 1975, and after <br /> approval by the council if required. <br /> (b) A lot of record existing upon January 1, 1975, in an R district, which does not meet the requirements of <br /> this chapter as to area or width may be utilized for a single-family detached dwelling purpose,provided <br /> that in the judgment of the council or administrative approval by the planning director, such use does not <br /> adversely affect public health or safety and the following requirements are met: <br /> (1) In R districts of one acre or less and served by public sanitary sewer. A lot of record existing <br /> upon January 1, 1975, in any R district of the city of up to and including one acre,which lot is <br /> serviced by public sanitary sewer and which does not meet the requirements of this chapter as to <br /> area or width only, may be utilized for single-family detached dwelling purposes without council <br /> approval if all other requirements of the underlying zoning district are met, including but not <br /> limited to required yards, setbacks, lot coverage by structures,hardcover, etc. However,the lot of <br /> record shall not be more intensely developed unless combined with one or more abutting lots or <br /> portions so as to create a lot meeting the requirements of this chapter <br /> 1 <br />
