I apologize for the length of time it's taken me to reply to your <br /> questions. <br /> According to Citv Code Section 78-1405(9)(i)(7)a gate can be constructed but must be a minimum of 40'from the edge <br /> of the paved road. A fence may be constructed, up to 42 inches high along the property line. There is not a current copy <br /> of a survey on file for your property so the property line must be identified by a surveyor to show a gate would meet the <br /> required setback and the fence would be within your property boundary and not within the right-of-way. A building <br /> permit application is required for a gate. <br /> A zoning permit is required to create a berm,and depends on the amount of fill moved (copy attached). Grading,filling <br /> or excavating 51 to 500 cubic yards requires a Minor Land Alteration. If the grading,filling or excavating exceeds 500 <br /> cubic yards, a Major Land Alteration is required which also requires a Conditional Use Permit and requires council <br /> approval. Regardless of the permit type, preliminary submittals include an updated survey showing where the berm will <br /> be constructed,the amount of cubic yards to be brought and/or moved around the site and existing& proposed <br /> topography. The berm must be constructed with your property boundary and not within the right-of-way.
