The Planning Commission made the following findings of fact: <br /> A. The berm was constructed in 1987. <br /> B. The added fill will widen the back side of the existing berm and will <br /> connect to a new berm being constructed on the adjacent property to the <br /> north. <br /> C. The proposed expansion will not interfere with on-site septic systems, <br /> wetlands or drainage patterns. <br /> 5. The City Council finds that granting a conditional use permit will not be <br /> detrimental to the health, safery or general welfare of the public, would not <br /> adversely affect light, air nor pose a fire hazard or other danger to neighboring <br /> properties, nor will its use depreciate surrounding property values and that the <br /> proposed level of use of the property will be in keeping with the intent and <br /> objectives of the Zoning Code and Comprehensive Plan of the City. <br /> 6. The City Council has considered this application including the findings and <br /> recominendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed conditional use permit on the <br /> health, safety and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a conditional use pernut per Municipal Zoning Code Section 10.03, Subdivisions 19-21 <br /> and Section 10.55, Subdivisions 8-14 to pernut expansion of an existing berm by adding 3,000 <br /> cubic yards to be located in the area as noted in Exhibit A. Approval was subject to the <br /> following conditions: <br /> 1. An erosion control plan including revegetation has been established in <br /> conjunction with improvements to County Road 6. <br /> 2. Applicants shall adhere to the construction plans as submitted with the <br /> application. <br /> Page 2 of 5 <br />
