As you are aware the property <br /> contains an existing barn which was left after a taking of the north portion of the property (including the house) for road <br /> right-of-way. The removal of the home from the property made the existing barn a non-conforming accessory structure <br /> (without the principal structure). Our City Code nonconforming structures and uses regulations (LINK) will allow you to <br /> maintain the barn or make improvements which do not result in a physical expansion of the structure (footprint or <br /> volume). <br /> You inquired about installing a well, septic system and half-bath in the barn. The City's code allows accessory structures <br /> to contain plumbing fixtures in a few ways, a toilet and sink(aka half-bath) are permitted as an accessory use upon the <br /> owner recording a covenant regarding the use of the structure in the chain of title of the property see the Code Section <br /> 78-1437 (LINK), or the addition of a shower or bath tub via a conditional use permit. I do think the City would approve a <br /> CUP for a full bath absent the principal structure; however I believe the half-bath would be acceptable provided the <br /> covenant is properly recorded. <br /> If you have questions please contact me directly.
