, � <br /> � O ' V <br /> O O <br /> �ab- - CITY of 4RON0 <br /> � � � <br /> ti <br /> �� �'�' RESOLUTION OF THE CITY COUNCIL <br /> t�kESHO�� NO. 3 0 9 6 <br /> A RESOLIITION GRANTING <br /> A VARIANCE TO MUNICIPAL ZONING CODE <br /> SECTION 10.28, SIIBDIVISION 5 (B) <br /> FILE #1719 <br /> WHEREAS , Henry Brantingham ( hereinafter "the <br /> applicant") is owner of the property located at 3185 County Road <br /> 6 within the City of Orono (hereinafter "City" ) and legally <br /> described as follows: <br /> That part of the west 371.31 feet of the Northwest Quarter <br /> of the Southwest Quarter of Section 28, Township 118 North, <br /> Range 23 West of the 5th Principal Meridian, lying south of <br /> the centerline of Hennepin County State Aid Highway Number <br /> 6, Plat 5, per pocument Number 3844152. <br /> (hereinafter "the property") ; and <br /> WHEREAS, the applicant has applied to the City for a <br /> variance to Municipal Zoning Code Section 10.28 , Subdivision 5 <br /> (B) to permit the construction of the addition to the south side <br /> of the existing residence. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1 . This application was reviewed as Zoning File #1719 . <br /> 2. The property is located in the RR-1B Zoning District. <br /> 3 . The Orono Planning Commission reviewed this application <br /> on March 16 , 1992, and recommended approval of the <br /> proposed variance based upon the fol lowing findings: <br /> A. The existing house does not meet the 50' rear lot <br /> line setback and no other add-on space is <br /> available for this structure. <br /> B. Expansion is limited to the north by the septic <br /> system and limited to the east and west by mature <br /> vegetation.
