Design, Ltd. <br /> Builder: John Kraemer& Sons <br /> Landscape Architect: Southview Design <br /> AVERAGE SETBACK VARIANCE REQUEST(42"TERRACE FROM EXISTING GRADE RULE): <br /> We are requesting a variance from the City of Orono on the Average Setback and the City <br /> Ordinance that requires any terrace built between the Average Setback (84.7') and the <br /> Lakeshore Setback (75') to be under 42"high from existing grade. <br /> As part of our respect for the lake, neighbors and City ordinances, we propose to abandon our <br /> ability to rebuild any hardcover inside the existing 782 sq ft of non-compliant hardcover and <br /> pull all new hardcover behind the 75' lakeshore setback. In lieu of rebuilding within the existing <br /> non-compliant hardcover, we are requesting a variance to be allowed to build a small portion of <br /> replacement lakeside terrace (282 sq ft) over 42" high above existing grade between the <br /> average setback and the lakeshore setback (Diagram AS-1). <br /> 1. Area of Variance: We would like to illustrate that this variance application only applies <br /> to 282 sq ft of the proposed 1,045 sq ft terrace shown (Diagram AS-1), since the <br /> remaining terrace area is either behind the 84.7' Average Setback or within the footprint <br /> of the existing home (Diagram AS-1). <br /> 2. Practical Difficulty: The current configuration of the sloping yard makes building a <br /> lakeside terrace in the allowable area difficult, resulting in a practical difficulty not <br /> consistent with the higher and flat neighboring lot to the West. The proposed design <br /> would maintain a flat, usable yard 6.0 feet below the neighboring lot (Diagram AS-3). <br /> a. We propose to remove the existing stairs and build new stairs entirely behind <br /> the 75' lakeshore setback resulting in zero hardcover inside the 75' setback. <br /> b. While moving the proposed slope to the East, we would not be increasing the <br /> angle of the slope nor changing the drainage to any neighboring lots or the lake <br /> itself(Diagram AS-3). <br /> 3. Conditional Use Permit: As part of this variance application, we will also be requesting a <br /> Conditional Use Permit for an additional 315 cubic yards of fill to create a level lakeside <br /> yard more synonymous with the neighboring property to the West. <br /> a. We request to extend the contour height of 948.0 across the useable lakeside <br /> yard as a continuation of the neighboring yard to the West (Diagram AS-2). <br /> b. Per the current ordinances, the proposed terrace will not exceed 42" in height <br /> above the proposed grade (Diagram AS-3). <br /> Page I 1 <br />
