.. . .s Sec.13.04 RIGIiTS OF SUB.TECTS OF DaTA Subd. 1. Type of data. The righ[s of individual on whom the dara is stored or ro be stoced shall be as set focth in this secdon. Subd.2. Information reqirired to be given iadividual. An individual acked to svpply private or confidenrial data conceming himseif shall be informed of: (a)�the purpose and incended use of the nquesud data within the collecdn$state agency,political subdivision,or statewide system; (b)whether he may refuse ot is legally required to supply the iequesud data;(c)any lmown coasequence arisiag from his supplying or refusing W supply private or coafidential data;and(d)the idenriry of other persoas or enrides authorized by state or fedecal law to receive the data. 'Ihis requirement shall not apply when an individual is asked to supply invesdgadve dara,pursuant to secdon 13.82,subdivision 5,to a law enforcement o�cer. The commissioner of revenue mav place the nodce rewired under this subdivision in the individual income raz or aronem taz refund instructions instead of on those forms. Subd.3. Access to data by individuai. Upon request to a respoasible authoriry,an individual shall be informed whether he is the subject of stored data on individuals,aad whe�her it is class�ed as public,private or confidenaal. Upon his further roquest,an individual who is the subject of stored private or public data on individuals shall be shown the data without aay charge to him and;if he desires,shall be informed of the content and meaniag of that data. After an individual has been shown the private dara and informed of its meaning,the data need not be disclosed to him for six months thereafter unless a dispuu or acaon pursuant to this section is pending or addidonal dara on the iadividual has been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of[he data. The responsible authoriry may require the requesdng person W pay the actual costs of making,certifying,and compiling the copies. The responsible authoriry shall comply immediately, if possible,with any request made pursuant W this subdivision,or within five days of the date of the requesc,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the mquest withitt that.time,he shall so inform the individual,and may have an addiaonal five days within which to comply with the request,excluding Saturdays, Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An mdividuat may conust the accumcy or completeness of public or private data conceming himself. To exercise this right,an individuat shall nodfy in wridng the responsible authoriry describing che nature of the disagreement. The responsible authoriry shall within 30 days either: (a)correct the data found ro be inaccurate or incomplete and aaempc to nodfy past recipieau of inaccurate or incomplete data,including recipienrs named by the individual;or(b)aoafy the individual that he believes the data W be correct Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed dara. The decerminadon of the responsible authoriry may be appealed punuant w the provisions of the adminisaative procedure act relating w contested cases.
