v Sec.13.04 RIGHTS OF S[JBJECTS OF DATA Subd. 1. Type oP data. The rights of individual on whom ti�e data is stored or to be stored shall be as set fonh in this section. Subd.2. Information reqirired to be�ven individual. Access to data by individual. Upon nquest to a�espoasibte aurhoriry,an individual shall be informed whether he is the subject of stored data on individuals,anci wherher it is class�ed as public,privace or confidendal. Upon his further request,an individual who is the subject of swred private or public data on individuals shall be shown the dara without any charge W him and;if he desires,shall be infora►ed of the content and meaning of rhat data. After an individual has been shown[he priva:e data and informed of its meaaing,the data need not be disclosed to him for six months thereafter unless a dispute or acrion pursuanc to this secdon is pending or addidonal data on the individua(has been collecud or created. The responsible authoriry shall provide copies of the privau or public dara upon mqaest by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making,certifying,and compiling the copies. The responsible authority shall comply immediately, if pouible,wirh any request made pursuant to this subdivision,or within five days of the date of the request,excluding Satucdays,Sundays and legal holidays,if immediau compliance is not possible. If he canaot comply with the request within that time,he shail so inform the individual,and may have an addidonal five days widiin which to comply with the request,excluding Saturdays, Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individual may conust the accuracy or completeness of public or private data eonceming himself. To exercise chis right,an individual shall nodiy in wricing the responsible authority describing the naare of the disagnement. The responsible authoriry shall within 30 days either: (a)cornct the dars found to be inaccurate or incompleu and aacmpt to nodfy past recipients of inaccurate or incomplete data, including recipients named by[he individuai;or(b)norify the individual thac he believes rhe daca to be correct. Data in dispute shall be disclosed only if the individual's stacement of disagreement is included with the disclosed data. The determinadon of the responsible authoriry may be appealed pursuant W the provisions of[he administrarive procedure act reladng to contesud cases.
