Supply the City with the appropriate individual for a 24 hour <br /> emergency contact for erosion control related issues; and <br /> xiii. When NPDES pennit coverage is obtained, provide the City <br /> with NPDES certificate of coverage; and <br /> xiv. Indicate who will be completing weekly ESC ins�ection log, <br /> and provide city with weekly copies of such log. <br /> 4. The City Council has considered this application including the findings <br /> and reconmzendation of the Plaiuiing Commission, reports by City staff, <br /> conunents by the applicants and the public, and the effect of the proposed <br /> variance on the healtl�, safety and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a conditional use permit per Orono Municipal Zoning Code Section 78-966 to <br /> allow a benn to be constructed subject to the following conditions: <br /> 1. Council approval is based on the site and grading plaii submitted by the applica�zts <br /> and annotated by City staff, attached to this Resolution as Exhibit A. Any <br /> amendments to the site plan which are not in conformity with City codes will <br /> require further Planni.ng Commission and City Council review. <br /> 2. The applicants shall comply with the recommendations of the City Engineer. <br /> 3. The applicants shall coinply with Municipal Zoning Code Section 78-1286 <br /> Subdivision E, standards for conditional uses. <br /> 4. Authorities granted by this resolution run with the property not with the <br /> applicants, but are pernlisssve only and must be exercised by obtaining a land <br /> alteration permit from the City prior to commencing site work. <br /> 5. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> Page 3 of 5 <br />
