F. Grantee may enter upon the Land for the purposes of inspection and <br /> enforcement of the covenants contained herein and to cause to be removed � <br /> from the land without any liability any structures, uses, materials, substances, <br /> or unnatural matter inconsistent with the covenants contained herein in the <br /> natural state of the Land, except as contemplated or specifically set forth in or <br /> as is otherwise necessary to accomplish the intentions of the parties to,the <br /> Easement Agreement. <br /> 2. Grantors hereby grant, gift, quit claim and convey to Grantee, a perpetual flowage <br /> easement and right and privilege to trespass with water over and upon any or all the <br /> Land, except to the extent the same is inconsistent with the terms and conditions <br /> specifically set forth in or the intention of the Parties to the Easement Agreement. <br /> 3. To the extent that there is any conflict between the terms, conditions, covenants and <br /> agreements set forth herein and in the Easement Agreement,the terms, conditions, <br /> covenants and agreements set forth in the Easement Agreement shall control. <br /> 4. Grantors herein do hereby remiss,release, acquit and forever dischazge the Grantee <br /> and any and all of its officers and employees of and from any and all claims, demands <br /> or causes of action of any kind or nature whatsoever which may arise or accrue by <br /> virtue of any flowage or trespass with water within the terms of this agreement and <br /> which is not inconsistent with the terms of the Easement Agreement. <br /> In addition to any other remedy that Grantee may have,the covenants and restrictions <br /> contained herein may be enforced by injunction. <br /> Grantors do not intend that the public should have any interest in the above Land by <br /> virtue of this indenture or otherwise, except as set forth herein above and/or in the Easement <br /> Agreement. <br /> The Grantors herein certify that the Land herein described is free and clear of all <br /> encumbrances except those contained in the Easement Agreement and: <br /> c:�wu�mows��as�rrr.noc�� 3 <br />
