1405 Sixth Ave.N.-Easement Amendment <br /> May 9,2012 <br /> Page 2 <br /> approval to amend the Conservation Easement to allow construction of a dock through the <br /> wetland within the parameters allowed by current Zoning Code. <br /> Staff Recommendation <br /> The 2005 Code revisions do not nullify the Easement provisions that are more restrictive than the <br /> current Code. Council action is required to approve an amendment of the Easement conditions <br /> to allow construction of a dock through the wetland. Based on the current code provisions this <br /> would seem reasonable, as long as all Code requirements and limitations for that construction are <br /> adhered to. Note that based on the topographic map attached, access to the lakeshore at either <br /> the existing or proposed location appears to require crossing near or over some portion of <br /> wetland in order to remain within the property boundaries. <br /> COUNCIL ACTION REQUESTED <br /> Provide direction to staff and Mr. Crotteau as to whether the Council would approve an <br /> amendment of the Easement to allow construction of a dock to the southwest. If so, the property <br /> owner should have his attorney draft the appropriate amendment for staff and City Attorney <br /> review and Council action. <br />
