�2�n,1 oUC� STS (Zoo q) <br />RELEASE OF RESTRICTIVE COVENANTS <br />City of Orono, a municipal corporation and political subdivision of the State of <br />Minnesota ("Declarant"), effective on the 7th day of May, 2004, hereby declares as follows: <br />RECITALS <br />A. Declarant is the fee simple absolute owner of that certain real property in <br />Hennepin County, Minnesota legally described in Exhibit A hereto (the "Property'). <br />B. Declarant previously subjected the fixture use of the Property to certain <br />restrictions and limitations (the "Restrictions and Limitations") set forth in that certain <br />Declaration of Restrictive Covenants recorded on August 6, 1996 with the Office of the Registrar <br />of Titles, Hennepin County, Minnesota. as Document No. 2731105 at page 841148 of Registered <br />Vol. 2819. <br />C. Declarant now desires to release the future use of the Property from the <br />Restrictions and Limitations so that fee title interest to the Property may be transferred by <br />Declarant to a third party free and clear of the Restrictions and Limitations. <br />D. The State of Minnesota, through its Department of Natural Resources, has <br />consented to the release of the future use of the Property from the Restrictions and Limitations, <br />such consent being evidenced in writing by that certain Amendment No. 1 to Grant NSOR96- <br />003, attached hereto as Exhibit B and made a part hereof. <br />DECLARATIONS <br />NOW, THEREFORE, in consideration of the foregoing recitals, the restrictions set forth <br />herein, and other good and valuable consideration, the receipt, sufficiency and fairness of which <br />is hereby acknowledged, Declarant does hereby declare as follows: <br />1. Release of Restrictions. The future use of the Property is released from the <br />Restrictions and Limitations imposed by that certain Declaration of Restrictive Covenants <br />recorded on August 6, 1996 with the Office of the Registrar of Titles, Hennepin County, <br />Minnesota as Document No. 2731105 at page 841148 of Registered Vol. 2819. <br />121089629v1 754068 <br />
