City Administrator <br />Date: May 23, 2012 <br />Subject: Park Dedication Fees - Review & Analysis <br />Attachments <br />A - 2011 Park System Analysis for Establishing Park Fee <br />B - Orono Code Section 82-227 (Park Dedication) <br />C - Orono 2012 Fee Schedule Excerpt re: Park Dedication <br />D - Minnesota Statutes 462.358 Subds. 2b and 2c <br />E - Orono Park System Map <br />F - Orono Comprehensive Trail System Plan <br />Background <br />Minnesota Statutes 462.358 Subd. 2c(a) requires that cities imposing park dedication requirements as <br />part of the subdivision process must show an 'essential nexus' between the fees being collected or land <br />dedication being required and the municipal purpose sought to be achieved by the fee or dedication. <br />The fee must bear a rough proportionality to the need created by the proposed subdivision or <br />development. <br />Orono established such a rationale and basis for its park dedication fees in 2001. This rationale has not <br />been reviewed since December 2001. Many of the assumptions behind the rationale may have changed <br />in the past 10 years. Additionally, some of the projected Park acquisitions in 2001 have come to fruition, <br />while others may no longer be appropriate for further consideration. For that reason, the attached <br />analysis is provided as an update and to generate discussion as to whether any revisions to the Park <br />Dedication ordinance are warranted. <br />COUNCIL ACTION REQUESTED <br />While staff does not propose any specific revisions, the information provided is intended to generate <br />discussion regarding the City's potential future park desires and needs, as well as the current Park Fee <br />cash requirements. <br />
