LA18-000084 CITY OF ORONO,TEXT AMENDMENT—GRADING AND LAND <br /> ALTERATION,8:44 P.M.—8:53 P.M. <br /> Oakden stated this text amendment pertains to land alterations which include grading, filling, and <br /> topographic alterations in all districts. Currently there is some confusion with the existing language by <br /> applicants. In addition, Staff will often discover a conditional use permit is required during the building <br /> permit review, which delays the application. Simplifying the existing code will clarify the process <br /> pertaining to land alteration permits and help streamline the permitting process. <br /> The City closely regulates grading and land alteration activities for several reasons, including the <br /> following: <br /> 1. To manage stormwater discharge, ensuring drainage does not negatively impact neighboring <br /> properties. <br /> 2. Manage hauling traffic and noise. <br /> 3. Preventing erosion issues into adjacent properties,wetlands, lakes,and roads. <br /> Within these goals, Staff proposes regulations that address the following situations: <br /> a. Mining <br /> b. Land alteration not associated with a building permit <br /> c. Land alteration of more than 50 cubic yards in the lake yard with or without a building permit <br /> d. Land alteration of more than 500 cubic yards within the Shoreland Overlay District,excluding <br /> activity directly related to building permits <br /> e. Grading and land alteration that serve to artificially raise the principal structure over X feet from <br /> existing grade; i.e., engineered grade <br /> f. Soil export not associated with a building permit <br /> g. Reduce or eliminate regulations that do not serve stated goals. <br /> The Planning Commission should discuss the scope of land alteration permits and provide direction to <br /> Staff to create proposed language. <br /> Chair Thiesse opened the public hearing at 8:48 p.m. <br />
