i �t2��� <br /> ' ' l� �`k�q�4 <br /> 1 a�84(,� 3 <br /> 1 r�v at�4 <br /> � O� ��Gloql'7 <br /> O i �8��$7 <br /> Oi�i4��i�y <br /> � CITY of ORONO `����23� <br /> � <br /> .� ,�. � <br /> ti <br /> ��� � �p~' RESOLUTION OF THE CITY COUNCIL <br /> `�kEsKo4 rvo. 5 5 9 g <br /> A RESOLUTION VACATING <br /> CERTAIN DRAINAGE AND UTILITY EASEMENTS <br /> WITHIN THE PLATS OF <br /> CRYSTAL CREEK; MEYER DAIRY ADDITION; <br /> SPRUCE ACRES; ORONO OAKS; AND WOOD END ACRES <br /> IN THE CITY OF ORONO, <br /> HENNEPIN COUNTY, MINNESOTA <br /> WHEREAS, the City of Orono is a municipal corporatioii organized and existing <br /> under the laws of tlie State of Minnesota; and <br /> WHEREAS, as part of the MnDOT Highway 12 relocation project, the <br /> Miruiesota Department of Transportation (MnDOT) acquired certain residential properties, <br /> portions of which will Uecome owned by the Burlington Northern and Santa Fe Railway <br /> Company(BNSF) for railroad right-of-way purposes; and <br /> WHEKEAS, as part of the pending ownership transfer, BNSF has required <br /> MnDOT to have existing drainage and utility easements vacated within the new railroad right-of- <br /> way where they no longer have any public purpose; and <br /> WHEREAS, on March 21, 2007, Lee Willianis on behalf of MnDOT (hereinafter <br /> the "petitioner") filed a petition and application with the City of Orono (hereinafter "the City") <br /> requesting the vacation of certaiu portions of the Drainage Easements and Drainage & Utility <br /> Easements dedicated within Outlot B, CRYSTAL CREEK; withi� Lots 3, 4, and 7, Block 1, <br /> MEYER DAIRY AllDITION; within Lots 1, 2, and 3, Block 1, SPRUCE ACRES; within Lots <br /> 1, 2, 3, 4, 5, and 6, Block l, ORONO OAKS; and within Lots 1 and 2, Block 1, WOOD END <br /> ACRES; and <br /> WHEREAS, the portions of said Easements to be vacated are formally and <br /> legally described in Cxhibit A attached hereto; an�i <br /> WHEREAS, after due published and posted notice, a public hearing was held by <br /> the Orono City Council on April 9, 2007 regarding said vacations and all interested persons were <br /> given an opportunity to be heard; and <br /> t <br />
