Schwingler stated as it relates to Commissioner Thiesse's comment, every piece of <br /> land is different and that the Planning Commission reviews the applications on a case-by-case basis. <br /> Schoenzeit moved,McGrann seconded,to recommend approval of Application No. 15-3769,Chris <br /> Lappen and Kallyn Bialowasa,3409 East Lake Street,granting of variances to the average <br /> lakeshore setback,lake setback,side yard setback,and hardcover,subject to conditions of Staff. <br /> VOTE: Ayes 6,Nays 0. <br /> NEW BUSINESS <br /> 3. #15-3791 JOSEPHINE CARPENTER,480 RUSSELL AVENUE,COMPREHENSIVE <br /> PLAN AMENDMENT,6:56 P.M.—7:05 P.M. <br /> Josephine Carpenter, Applicant, was present. <br /> Gaffron stated the applicant is requesting an amendment to the 2008-2030 Orono Comprehensive Plan so <br /> the property can be added to the defined Metropolitan Urban Service Area(MUSA) in order to make the <br /> property eligible for installation of sanitary sewer. <br /> The property at 480 Russell Avenue contains an existing residence with a septic system that is <br /> noncompliant and is in the process of being sold by the current owner who has lived there for a number of <br /> decades. The owner is requesting an amendment of the Comprehensive Plan to incorporate the property <br /> into the MUSA to allow it to be connected to the municipal sewer. An amendment of the Comprehensive <br /> Plan requires City approval as well as Metropolitan Council approval. This amendment is anticipated to <br /> meet the criteria for a minor amendment that will shorten the Metropolitan Council review process. <br /> The public hearing is a required first step in the process for completing a Comprehensive Plan <br /> Amendment. Once the Planning Commission has completed the public hearing and recommended <br /> approval, a resolution will be presented to the City Council for conditional adoption of the amendment <br /> subject to Metropolitan Council approval. Once the Metropolitan Council has approved the amendment, <br /> the City can formally adopt it by resolution. <br /> The primary intent of this amendment is to make it possible for the property at 480 Russell Avenue to be <br /> allowed to connect to municipal sewer. The existing house was built in 1939 and the property does not <br /> have sites available for construction of a replacement septic system. <br /> Gaffron displayed a map depicting the MUSA. The property was initially anticipated to be included <br /> within the 1980 Minnetonka Bluffs municipal sewer project area. At the time the project was being <br /> designed, properties on the fringe of the project area were given the choice of opting out of the project <br /> based on their potential ability to use septic systems on a permanent basis. The owners of the subject <br /> property requested to not be included in the project based on the 1.8 acre size of the property unless they <br /> were granted two sewer units. Due to the 2-acre zoning,the City Council elected to not provide sewer to <br /> the property and it was not assessed for sewer. <br /> Page 6 of 29 <br />
