MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,March 16,2015 <br /> 6:30 o'clock p.m. <br /> It is Staffs opinion at this time, in conjunction with that of the City Attorney,that an amendment of the <br /> Comprehensive Plan is not strictly required in order for this property to be developed at the proposed <br /> density with four twinhomes. A rezoning of the property, however, is required. <br /> The Planning Commission is requested to consider whether the proposed development of four twinhomes <br /> is appropriate for this site and then make a recommendation to the City Council regarding a future <br /> rezoning to RPUD. Since a rezoning action is highly discretionary,the zoning code does not specify <br /> criteria by which a rezoning should be considered. The Code merely suggests that rezoning is appropriate <br /> if the Council finds it to be"in the best interest for the physical development of the City." <br /> Gaffron stated in order to provide the Planning Commission with potential findings to make a <br /> recommendation,they should answer the questions outlined on Page 5 of Staffs report. <br /> Gaffron stated if the Planning Commission decides to approve the application,they should include the <br /> following recommendations of Staff in their motion. <br /> 1. Landscape plan must provide a substantial coniferous planting plan along the south side of the <br /> new twin home structures. <br /> 2. The twin home structures shall be located no closer than 40 feet to the east property line and the <br /> private drive shall be located no closer than 20 feet to the east property line. <br /> 3. The final development plan should preserve to the greatest extend possible all existing mature <br /> trees and underbrush on the property and maintain all undisturbed land not approved for site <br /> grading and improvement in its natural state. <br /> 4. The development shall be prohibited from any type of subdivision entryway signage on Kelly <br /> Avenue, except for an approved private street name sign. <br /> 5. The dead-end turn-a-round design at the end of the private street shall be subject to final design <br /> approval of the Fire Chief. <br /> 6. Final road design shall be established in a manner that can be converted to readily gaining access <br /> from Shadywood Road if that becomes feasible in the future, and provisions for future <br /> elimination of the access to Kelly Avenue should be a consideration in the initial road design. <br /> 7. If a reduced private street improvement width is proposed and approved for less than the standard <br /> 28 feet minimum, and which includes available off-street bump-out visitor parking areas,then on- <br /> street parallel parking shall be prohibited along both sies of the private roadway. Signs restricting <br /> such parking shall be installed and maintained by the homeowner association if needed to assure <br /> full access to all dwellings by emergency personnel. <br /> 8. All pertinent requirements of the Orono Subdivision Code and RPUD District standards shall be <br /> adhered to during the development review and approval process. Particular attention shall be <br /> paid to stormwater management within the development site to ensure the development does not <br /> have negative impacts downstream. <br /> Page 4 of 30 <br />
