MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,August 18,2014 <br /> 6:30 o'clock p.m. <br /> There were no public comments regarding this application. <br /> Chair Leskinen closed the public hearing at 6:36 p.m. <br /> Leskinen stated she remembers discussing this application previously and that she does not have a <br /> problem re-instating the variances. <br /> Lemke moved,Thiesse seconded,to recommend approval of Application No. 11-3520,Christian <br /> and Beth Johnson, 1376 Baldur Park Road, renewal of hardcover variance approvals consistent <br /> with Resolution No.6074. VOTE: Ayes 6,Nays 0. <br /> 3. #13-3622 LANDSOURCE,LCC, 1645 SHADYWOOD ROAD,AMENDMENT TO <br /> PRELIMINARY PLAT,6:37 P.M.—6:43 P.M. <br /> Todd Holmers, Applicant, was present. <br /> Gaffron stated the applicants are requesting revision to preliminary plat approval granted via Resolution <br /> NO. 6338 in November of 2013. The front lot originally approved at 1.0 acre in area is now requested to <br /> be reduced to 0.75 acre. <br /> The applicants originally requested a 2-lot plat with a front lot at 0.51 acre and a back lot at 1.86 acres. <br /> After the public hearings, the applicants revised that plan to increase the front lot to 1.00 acres, which <br /> gained preliminary plat approval in November of 2013. <br /> The applicants, in preparing their final plat application, are now requesting a revision to decrease the front <br /> lot to 0.75 acres. Staff's determination of whether the proposal to reduce the size of the front lot <br /> constitutes a"substantial change"took into consideration the following factors: <br /> 1. At the July 14 Council meeting, a question was raised as to whether the changes to the Northern <br /> Oaks plat due to the re-defined wetland boundaries would be considered as a"substantial change" <br /> and require it to go through preliminary plat approval again. One of the justifications for that not <br /> being deemed a substantial change was that lot lines weren't changing; and <br /> 2. During the preliminary review of the front-back lot split,the level of neighborhood concern was <br /> reduced when the front lot went from one-half acre to one acre and the house location moved <br /> westward. Reducing its size now without an additional public hearing at the Planning <br /> Commission would be inappropriate given the past public comments. <br /> The reduction in area of the front lot from one acre to 0.75 acre also reduces the depth of the lot from just <br /> under 400 feet to just under 300 feet The proposed house location on the front lot has been moved <br /> forward to be more centered on the lot, meeting all setback requirements. The length of driveway that is <br /> shared by Lots 1 and 2 decreases slightly and reduces hardcover as compared to the prior approved <br /> proposal. <br /> Both revised lots will meet the hardcover limits. The revised proposal results in the removal of <br /> approximately four mature trees whereas the original proposal would likely have removed two. The <br /> proposed house location on the back lot does not change as a result of the lot size revisions. <br /> Page 2 of 33 <br />
