MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,August 18,2014 <br /> 6:30 o'clock p.m. <br /> Thiesse stated the only difference is that they had all the information before them that they could consider <br /> and that this Planning Commission is being asked to not consider the Special Lot Combination <br /> Agreement. <br /> Leskinen stated in her case the Special Lot Combination Agreement makes it more difficult since it exists <br /> until it has been extinguished, but that it does not impact her decision. Leskinen stated in her view the <br /> proposed house is too much for the lot, is too far in front of the average lakeshore setback line, and <br /> impedes the view of the neighbor. <br /> Schwingler stated the house will impact the entire neighborhood and that the Planning Commission <br /> typically attempts to mitigate those issues with the neighbors. <br /> Leskinen stated she generally is a little more flexible on the average lakeshore setback in certain cases, <br /> but that this is so clearly interfering with the view that it makes it hard to justify it. <br /> Lemke moved,McGrann seconded, to recommend denial of Application No. 14-3675,Ryan and <br /> Stacy Alness,XXX Elmwood Avenue/PID 07-117-23-11-0027. VOTE: Ayes 6,Nays 0. <br /> Gaffron noted this will be before the City Council on September 8. <br /> Landgraver asked if the application will be framed the same way. <br /> Gaffron indicated it will be. <br /> 7. #14-3678 ARCHITECTURAL LANDSCAPE DESIGN ON BEHALF OF BRET AND <br /> JENNIFER RIEMENSCHNEIDER,835 FOREST ARMS LANE,VARIANCE,8:03 P.M.— <br /> 8:12 P.M. <br /> Laura Westrude, Architectural Landscape Design, was present. <br /> Curtis stated the applicants are requesting an average lakeshore setback variance to permit the <br /> construction of an elevated deck on the lakeside of the home with a three-season porch beneath and an <br /> entry pergola completely ahead of the average lakeshore setback line. The existing lakeside grade level <br /> deck will be removed and replaced with a larger patio. <br /> The location of the applicants' home is also partially ahead of the average lakeshore setback line, and as a <br /> result, there is no conforming location lakeward to construct structural improvements. With the exception <br /> of the average lakeshore setback,the proposed improvements meet all other required setbacks. <br /> The proposed deck and screen porch will extend 19 feet from the house and as much as 21 feet ahead of <br /> the average lakeshore setback line. Curtis indicated she did speak with the applicants earlier tonight and <br /> they stated they may raise an option to further extend the deck, but the plan as originally proposed has the <br /> deck 21 feet ahead of the average lakeshore setback line. <br /> Curtis stated the fireplace is proposed to be located below the deck within the footprint of the deck and <br /> screen porch. The patios, grilling station, water feature and sitting walls are less than 42 inches from <br /> grade and are not required to be located behind the average lakeshore setback line. <br /> Page 17 of 33 <br />
