MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,July 21,2014 <br /> 6:30 o'clock p.m. <br /> file new deeds based on new legal descriptions. Staff will work with the property owner and the City <br /> Attorney to ensure that the necessary documents are prepared and filed. The Planning Commission <br /> should hold the public hearing regarding the lot line rearrangement and make a recommendation to the <br /> City Council. <br /> Curtis stated the applicant has provided Staff tonight with a driveway access plan for 2470 and 2490, <br /> which is a shared driveway situation. If new easements need to be executed, they should be prepared and <br /> ready for recording with the lot line rearrangement approval resolution. <br /> Curtis stated the applicant and the adjacent property owner is present tonight. <br /> Thiesse asked if the house will be demolished. <br /> Curtis stated that appears to be the plan at some point in the future based on the sketch submitted for <br /> access. <br /> Thiesse stated if the lot line rearrangement is approved, it is likely the Planning Commission would <br /> require that the house be in a conforming location, but if it is to be removed,that would not be an issue. <br /> Gustafson stated they are not proposing to remove the house at this time. <br /> Thiesse stated if the house is not removed,the house would be nonconforming. <br /> Curtis stated if the existing house is not removed and is required to be conforming to the setback, it would <br /> make Parcel No. 2 significantly smaller. <br /> Sven Gustafson, Applicant, stated they have not come to a conclusion on which method of access they <br /> would prefer. Gustafson indicated his attorney has reviewed the easement documents and that they have <br /> been submitted to the City. Gustafson stated there are easement documents that appear to indicate they <br /> can tie into the existing driveway that abuts Lake Minnetonka on the north but that there are some <br /> questions about how they were written. Gustafson indicated he is waiting to hear back from the City <br /> Attorney on that issue. <br /> Gustafson stated three access points off of a curb cut is acceptable but maybe not preferential. Gustafson <br /> asked if Staff would prefer two or three access points. <br /> Curtis stated there are currently two properties accessing off of the Edwards driveway, and to avoid the <br /> creation of a new curb cut for the existing number of lots,that driveway could be used for a third access <br /> point. Curtis stated whether a third curb cut should be created has yet to be determined. <br /> Leskinen asked where the access point would be. <br /> Curtis illustrated the location of the access up to Carman Street. <br /> Gustafson stated off the screen to the right are two existing homes that use the easement up to Carman <br /> Street. <br /> Leskinen asked where the new access point would be located. <br /> Page 21 of 30 <br />
