MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,May 19,2014 <br /> 6:30 o'clock p.m. <br /> Leskinen stated she does not believe it would increase the hardcover if the shed is removed. <br /> Schoenzeit stated the walls of the garage do not have to be made square. <br /> Leskinen stated she would like to have a motion covering all the issues to avoid the applicant having to <br /> come back but that the issue of the shed needs to be addressed. Leskinen stated the applicant can either <br /> put the shed in a conforming location or increase the size of the garage. Leskinen stated she is not sure <br /> whether the application would need to come back if the applicants can redesign it in such a way that it <br /> will be conforming. <br /> McGrann asked if the Planning Commission can approve a variance on the east side without notifying the <br /> public. <br /> Gaffron stated technically the Planning Commission should not approve it without providing notice. <br /> Schoenzeit stated the Planning Commission could approve adding the space if it meets the setback but if <br /> it encroaches,the application should come back to the Planning Commission. <br /> Schoenzeit moved to recommend approval of Application No. 14-3664,David Schmid and Angela <br /> Ciliberto,3309 Crystal Bay Road,granting of a conditional use permit; granting of lot area and <br /> width variances; granting of a hardcover variance; granting of lake setback and rear setback <br /> variances,subject to Staffs and the City Engineer's recommendations,with the applicant being <br /> given the option to either relocate the shed in a conforming location or to add the equivalent <br /> amount of square footage on to the house or garage in a conforming location,with the <br /> understanding the application will need to come back before the Planning Commission if the <br /> additional square footage is not in a conforming location; and subject to City Staff conducting a <br /> pre-inspection and post-inspection of the roadway. <br /> Landgraver suggested Staff's recommendation that all necessary precautions are taken to ensure that the <br /> mature oak is not impacted by the construction be amended to say all reasonable precautions. Landgraver <br /> stated in his view that is a fairly restrictive condition given the fact that it is a large oak tree,the new <br /> house is being moved forward, and the old house is being removed. <br /> Thiesse asked if the tree is outside the 0-75 foot zone. <br /> Gaffron indicated it is within the 0-75-foot zone. Gaffron stated the applicants could be required to <br /> replant if the oak tree is removed or dies as a result of the construction. <br /> Landgraver concurred with that recommendation. <br /> Schoenzeit amended his motion,McGrann seconded,to recommend approval of Application No. <br /> 14-3664,David Schmid and Angela Ciliberto,3309 Crystal Bay Road,granting of a conditional use <br /> permit; granting of lot area and width variances; granting of a hardcover variance; granting of <br /> lake setback and rear setback variances,subject to Staffs and the City Engineer's <br /> recommendations,with the applicant being given the option to either relocate the shed in a <br /> conforming location or to add the equivalent amount of square footage on to the house or garage in <br /> a conforming location,with the understanding the application will need to come back before the <br /> Planning Commission if the additional square footage is not in a conforming location; and subject <br /> Page 8 of 31 <br />
