MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Tuesday,January 21,2014 <br /> 6:30 o'clock p.m. <br /> Gaffron stated the Planning Commission should consider the following issues: <br /> 1. The topographic data and design information available to date is insufficient to accurately <br /> determine whether or to what extent filling in the floodplain will be required. The contours of <br /> 930', 931.5' and 932' indicate the tank will be buried lakeward of the 931.5 foot contour, but in <br /> order to determine the actual decrease in flood storage that may need to be mitigated will require <br /> additional survey work. <br /> Gaffron noted the actual amount of new fill above existing grade is likely to be less than ten cubic yards. <br /> Prior to issuance of a permit for the tank installation, Staff would require the applicants to provide the <br /> detail necessary and confirm that any required permits from MCWD have been obtained. <br /> 2. The applicants must obtain LMCD permits for the gas dock facility prior to tank installation. <br /> 3. If the tank installation will have an impact on the parking layout, the applicants need to address <br /> that as part of this commercial site plan review. <br /> 4. The tank location proposed will be less than ten feet from the north lot line of tax parcel <br /> 11-117-23-22-0007, and the fuel line to the gas dock will extend over tax parcels 0005 and 0006. <br /> Staff recommends that these three tax parcels be combined. The alternative is to combine just <br /> 0006 and 0007 to avoid the need for a setback variance and establish an easement between the <br /> combined 0006-7 and 00005 to accommodate all components of the fuel system. <br /> Staff recommends approval subject to the following conditions: <br /> 1. Combination of tax parcels 0005-6-7. <br /> 2. Prior to permit issuance,the applicants should submit adequate data to determine volume of fill <br /> below 931.5' and obtain any necessary permits from MCWD. <br /> 3. Prior to permit issuance, applicants should submit LMCD permits for the gas dock facility. <br /> 4. Mechanical permit application subject to review of the building official and Long Lake Fire <br /> Chief. <br /> 5. Installation and operation of the fueling system shall meet all City and state requirements. <br /> Schoenzeit asked if the fuel storage tank is just for the boat club or whether it will eventually be available <br /> to the public. <br /> Gaffron stated the applicants have indicated that initially it will just serve the boat club but that the <br /> applicant will need to address the potential for future use. Gaffron stated in his view there will be a <br /> benefit of selling gas to the general public, which would likely require the applicants to go through the <br /> LMCD process again. <br /> Schoenzeit stated the next question would be, if gas is being sold to the public, whether a 2,000 gallon <br /> tank will be sufficient and how often it would need to be refilled. Schoenzeit stated he is also not sure <br /> where the 932.5' elevation is and whether the tank would be in the floodplain. <br /> Page 14 of 26 <br />
