�o�o <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CIT'Y COUNCIL <br /> � � <br /> �� �ti <br /> G No. 64 � 4 <br /> tqkFs H o��' <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a conditional use permit and commercial site plan approval pursuant Municipal <br /> Zoning Code Sections 78-142 and 78-348(7); and grants approval of a variance from <br /> Municipal Zoning Code Section 78-1700 in order to allow construction of a 3,224 square <br /> foot building addition resulting in 47% hardcover; subject to the following conditions: <br /> 1. Council approval is based on the survey/site plan and general building addition <br /> design plans submitted by the Applicant and annotated by City staff, attached to <br /> this Resolution as Exhibits B and C (hereinafter the "Plans"). Any amendments <br /> to the Plans which are not in conformity with City codes will require further <br /> Planning Commission and City Council review. <br /> 2. Applicant shall be required to submit an as-built survey for the building addition <br /> after it is constructed. <br /> 3. Applicant shall provide maintenance records for the storm water pond prior to the <br /> issuance of the building permit to construct the building addition. <br /> 4. Authorities granted by this resolution run with the Property not with the Applicant <br /> or Owner, but are permissive only and must be exercised by obtaining a building <br /> permit for the building addition within one year of the date of Council approval, or <br /> the conditional use permit, variance and site plan approvals will expire on that <br /> date (February 9, 2016). <br /> 5. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> 6. The undersigned Owner has read understands and hereby agrees to the terms of <br /> this resolution and on behalf of the Owner and the Owner's heirs, successors <br /> and assigns, hereby agrees to the recording of this resolution in the chain of title <br /> of the Property. <br /> Page4of5 <br />
