This Appendix S forms a part of a!I <br /> such contracts. The term "P/TCS Manage�' shall include the Manager's designates or <br /> representatives. The Manager may, as often and at such times as the Manager shall deem <br /> desirable, make on-site reviews or other Cont�Cts to asce�tain compliance with H�nn�pin County's <br /> SBE requirements_ <br /> � <br /> The SBE utilization goal is up to 20%, based on the opporEunity for contracti�g and <br /> subcontracting and the avallabillty of certifled SBEs. This SBE utilization goal applies to the <br /> original dollar val�e of this contract. Hennepin County Purchasing/Targeted Contract Services will <br /> use the Prime/SubcontraCtor's PartiCipation Form (SBE6) to determine if the CONTRACTOR meets <br /> this goai. Form (SBE6) must list atf of the subcontractor/supplier(s) to be used on the project, <br /> indicate the contract amount for each subcontractor/supplier, and identify which <br /> subcontractor/supplier(s) comprise CONTRACTOR'S S6E utilization. Pr9me/Subcontractor's <br /> Participation Form (SBE6) is a part of this contract as though fully set fprth herein. <br /> EXCEPTIONS TO SBE REQUIREMENTS � <br /> The CONTRACTOR may request an exception to the SBE goal reqc�iremenf based upon any one of <br /> the fallowing Sifuations: <br /> a) Contracts with Gove�nment Jurisdictivns <br /> This exemption applies when another govemment jurisdiction or quasi-governmental <br /> agency is contracting with the county. <br /> b) Emergency-Related Purchas�s <br /> This exception applies for emergency or life-safety (threatening), related purchases <br /> authorized by the County Administrator, Depufy Administra#or, or the Purchasing <br /> Manager. <br /> c) Sole-Source o� Uniyue Goods, Commoditles� or Servlces <br /> This exception applies ta requests f¢r bids/proposals in which the scope is necessarily <br /> written such that there is only one source, regardless of the marketplace that possesses <br /> the capability to perform the contract. <br /> d) Self-Pertormance <br /> This exception applies to prime contractors who self-pertorm more work than the stated <br /> goa! ailows.
