.-. <br /> _ ` <br /> Sec.13.04 RIGHTS OF SUBJECTS OF DATA <br /> Subd.l. Type of data. T6e rights of individual on whom t6e data is stored or to 6e stored shall be as set forth in this section. <br /> Subd.2. Information required to be given iedivldual. Aa individual asked to supply private or rnntidential data concerning himself s6a11 be <br /> informed of: (a)the purpose and intended use of the requested data within the collecting state agency,political subdivisioo,or statewide system;(b) <br /> whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from 61s supplying or retusing to supply <br /> private or contidential data;and(d)the identity ot other persons or entities suthorized by state or federal law to receive t6e data. This requirement shall <br /> not apply when an individual is asked to supply investigative data,pursuant to section 13.82,subdlvislon 5,to a law enforcement oft7cer. <br /> The commissioner of revenue mav olace the notice reauired under this subdivision in the individual income tax or urouertv taa refund <br /> instructlons instead of on those torms. <br /> Subd.3. Access to data by individual. Upon request to a responsible authority,an individual shall be informed whether he ls the subjeM of <br /> stored data on individuals,and whether it is classiRed as pubtic,prlvate or confidential. Upon hIs furt6er request,an individual who is the subject of <br /> stored private or publlc data oo individuals shall be s6own the data without any charge to hlm and,if he desires,s6a11 be informed of t6e antent and <br /> meaning of that data. After an iadividual has been shown the private data and informed of its meaning,t6e data oeed not be disclosed to him for six <br /> months thereafter unless a dispute or actton pursuant to this section is pending or addltional data on t6e individual6as been collected or created. The <br /> responsible authority shall provide coples of the private or public data upon request by the indlvidual subject of the data. The responsible authorlty may <br /> require the requesting person to pay t6e actual costs of making,certifying,and compiling the rnpies. <br /> T6e responsible authority shall comply Immediately,if possible,with any request made pursuant to t6is subdivision,or within five days of the <br /> date of the request,excluding Saturdays,Sundays and legal holidays,If immediate rnmpl(ance ls not possible.If he nnnot comply with the request within <br /> that time,he shall so intorm the indlvidual,and may have an addltlonal tive days within which to comply with the request,ezcluding Saturdays,Sundays <br /> and legal6olidays. <br /> Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data <br /> concerning himself. To exercise this rlght,an individual shall notify in writing the responsible sut6ority describing the nature of the dlsagreement The <br /> responsible aut6ority shall wit6in 30 days elther: (a)rnrrect the data found to be inaccurate or Incomplete and attempt to notify past reclpients of <br /> inaccurate or incomplete data,including recipients named by the individual;or(b)notify the individual that 6e believes the data to be rnrrect. Data In <br /> dispute shall be disclosed only if the lndivldual's statement ot dlsagreement Is included with the dlsclosed data. <br /> T6e determinatlon of the responsible authority may be appealed pursuant to the provisioos of the administrative procedure act relating to <br /> contested cases. <br /> DATA PRIVACY ADVISORY <br /> In accordance with M.S.13.04,Subd.2,"Rights of subjects of data",we would like to inform you that your request <br /> for a permit or license from the City of Orono or any of its departments may require you to furnish certain private or <br /> confidential information. <br /> You are notified that: <br /> 1.
