This application was reviewed as Zoning File#10-3466. <br /> 2. The Planning Commission reviewed this application on May 17, 2010 and on a <br /> vote of 6 - 0 recommended approval of the conditional use permit based the <br /> request complying with the requirements of Orono Code Section 78-916. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by Ciry staff, <br /> comments by the applicant and the public, and the effect of the proposed <br /> conditional use on the health, safety and welfare of the community as well as <br /> the impact on properties in the vicinity. <br /> 5. The City Council fmds that the proposed location of the conditional use is in <br /> accord with the objectives and purposes of the B-1 Retail Sales zoning district <br /> in which the site is located and with the comprehensive municipal plan and that <br /> the proposed sports and health club would not be detrimental to the public <br /> health, safety or welfare, or materially injurious to properties or improvements <br /> in the vicinity. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a conditional <br /> use permit for a sports and health club, subject to the following conditions: <br /> 1. The sports and health club shall occupy only the premises commonly known as 3384 <br /> Shoreline Drive, as shown on the attached Exhibit A. The premises consist of the first <br /> floor and basement, comprising in total about 1,950 square feet. <br /> 2. The sports and health club shall not be open before 6:00 am or after 10:00 pm. <br /> 3. Authorities granted by this resolution run with the property not with the Owner or <br /> Applicant, but are permissive only and must be exercised by opening the sports and <br /> Page 2 of 3 <br />
