Box 66 i . �_�.f,?� , __ __. <br /> Crystal Bay, 1�T 55323-0066 <br /> Dear Mr. Gerhardson: <br /> Thank you for your letter of June 1, 1994 wherein the City <br /> offers to pay the swa of $2,900.00 or $1.00 per square foot for <br /> the easement over the property located at 3416 Shoreline Drive, <br /> Navarre, Minnesota which is owned by myself and Mr. Germundsen. <br /> Back in 1988, the County undertook to upgrade County Road 15 <br /> which runs in front of our property. At that time, condemnation <br /> proceedings were commenced and the County took a permanent <br /> easement of 1,497 square feet and a temporary slope easement of <br /> 655 feet for a one (1) year period of time. <br /> Following an Award made by the Commissioners in 1989, this <br /> matter was appealed to the Hennepin County District Court wherein <br /> the County and the undersigned settled our claim for compensation <br /> on the property taken for the gross sum of $14,000.00. I enclose <br /> for your review a copy of the Stipulation for Settlement executed <br /> by myself and Mr. James H. Gaffney, Assistant Hennepin County <br /> Attorney. <br /> It is my belief that the compensation owing to Germ-Tom <br /> Partnership for the easement at issue should be in line with the <br /> amount paid by Hennepin County back in 1989, and increased by the <br /> rate of 3 percent per annum (the normal appreciation rate for <br /> commercial property) . <br />
