<br /> A RESOLUTION
<br /> AMENDING RESOLUTION NO. 5803
<br /> FILE NO.08-3381
<br /> WHEREAS, Brook Investment Group, LLC, (hereinafter "the Owner") is the owner of
<br /> the property located at 3435 Shoreline Drive within the City of Orono (hereinafter the "City")
<br /> and legally described as Tract B, RLS 1422, Hennepin County, Minnesota (hereinafter the
<br /> "Property"); and
<br /> WHEREAS, on January 26, 2009, the City Council adopted Resolution No. 5803
<br /> granting a conditional use permit to operate a bowling center on the Property, requiring the
<br /> bowling center open within one year or grounds would exist to revoke the conditional use
<br /> permit; and
<br /> WHEREAS,on January 25, 2010, the City Council adopted Resolution No. 5907
<br /> extending the time to open the bowling center to Apri126, 2010.
<br /> WHEREAS, on April 12, 2010, the City Council adopted Resolution No. 5925 extending
<br /> the time to open the bowling center to July 1, 2010.
<br /> WHEREAS, while Barry Tanner, proprietor of the bowling center, has made substantial
<br /> progress toward opening the bowling center, he estimates it will take additional time to complete
<br /> the work and requests an extension of the time allowed to open the bowling center.
<br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota,
<br /> that Resolution No. 5803 is hereby amended to allow the bowling center until October 30, 2010
<br /> to open. Resolution No. 5803 otherwise remains in effect.
<br /> Adopted by the Orono City Council on the 13�' day of September,2010.
