LEASE MODTFICATION AGREEMENT <br /> � This Lease Modification Agreement,made and entered into this day of�1ati_2011,by <br /> and between Brook Investment Group, LLC, hereinafter referred to as "Landlord" and O'Reilly <br /> Automotive Stores, Inc., hereinafter referred to as "Tenant". <br /> WITNESSETH: <br /> Whereas,under Lease dated November 12,2010,(hereinafter"the Lease"),Landlord leased <br /> to Tenant the premises located at 3423 Shoreline Drive,Orono,MN,as more particularly described <br /> in"the Lease"and on the terms and conditions set out therein, and; <br /> Whereas, the parties hereto desire to amend, modify, and supplement the Lease such as to <br /> modify Section 14, replace the existing Exhibit B-2 and add Exhibit B-3. <br /> Now therefore,in consideration of the promises,covenants and agreements hereinafter set out <br /> it is agreed by and between the parties as follows: <br /> 1. Landlord and Tenant mutually agree to delete the existing Section 14 in its entirety and <br /> replace with the following: <br /> Tenant shall be allowed to install its national sign, logo and color to the front exterior <br /> surface of the Demised Premises,as shown on Exhibit B-1 and shall also have the option <br /> of placing its prototypical red background behind Tenant's building signage,as shown on <br /> the attached Exhibit B.
