� ` i Sec.13.04 RIGA'TS OF SLfBJECTS OF D?►TA Subd. 1. Type of data. The rights of individoal on whom che data is stored or to be stored shall be as set forth in this secaon. Subd.2. Information reqirired to be givm individual. An individual asked to supply private or confidendal dara concerning himself shall be informed of: (a)�he puipose and inrended use of the requesced data within the collecting state agency,political subdivision,or satewide system; (b)whether he may refuse oY is legally required to supply the requesud data;(c)any lmown consequence arising from his supplying or nfusing to supp(y privau or confidential data;and(d)the idenriry of orher persoas or endaes aurhorized by state or fedecal law to receive the data. This requirement shall not apply when an individual is asked to supply invesogaave dara,punuant co secdon 13.82,subdivision 5,to a law enforcement officer. Access to data by individual. Upon request to a respoasible authoriry,an individual shall be informed whether he is the subject of stored data on individuats,and whe[her it is class�ed as public,priva[e or co�dendal. Upon his further request,an individual who is the subject of stored private or public data on iadividuals shall be shown the data without any charge to him and,-if he desires,shall be informed of the content and meaning of that data. Aher an individual has been shown the private data and informed of its meaning,the data need not be disclosed to 6im for six months thereafur unless a dispute oc acdon pursuanc to this secrion is pending or addidonal data on the individual has been collected or created. The responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority tnay require the mquesting person W pay the actual costs of making,certifying,and compiling the copies. The responsible aurhoriry shall comply immediately,if possible,with any request made pursuant to this subdivision,or wittiin five days of the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possibte. If he cannot comply with the request within that_tune,6e shail so inform the individual,and may have an addiaonal five days within which to comply with the request,exciuding Satucdays, Sundays and legal holidays. Subd.4. Procedure whea data is not accurate or complete. An mdividual may conrest the accurdcy or completeness of public or private data conceming himself. To exercise this right,an individual shall nodfy in wridng the responsible authoriry describing rhe nature of the disagreement. The responsible authoriry shal(within 30 days either: (a)correct the data found to be inaccurate or incomplete and aaempc to nodfy past recipients of inaccumte or incomplete data, including rocipientc named by the individual;or(b)notify the individual that he believes rhe data w be correcc. Data in dispute shall be disclosed only if the uidividual's statement of disagreement is included with the disclosed data. The determinadon of the responsible authoriry may be appealed pursuant W the provisions of the adminisaariv�procedure act relaang to conusted cases.
