� ITEM <br /> 6C <br /> LAKE MINNETONKA CONSERVATION DISTRICT <br /> RE: APPLICATION OF BERTA KVANIl�IE <br /> FINDINGS <br /> On November 12, 2014, at 7:00 p.m., pursuant to due notice, a public hearing was held <br /> by the Lake Minnetonka Conservation District ("LMCD") Board of Uirectors at the Wayzata <br /> City Hall in the City of Wayzata, Minnesota. The hearing. was��ield to consider the <br /> application by Berta Kvamme ("Applicant") for a dock length,variance for property at 2050 <br /> Shoreline Drive in the City of Orono(the "Site"). � �� � <br /> : �. <br /> The Applicant seeks a length variance for construction`of a docic�t�the Site, which has <br /> approximately 291 feet of shoreline at elevation 929:4 NGVD. The varian�e requested is to <br /> authorize construction of a dock extending 200 feet from the shoreline at �le�ation 929.4 <br /> NGVD. <br /> The hardship cited by Applicant as justification for,t[�e variance is shallow water in the <br /> dock use area. The Applicant submitted evidence that it is'necessary to extend the dock 200 <br /> feet from the shoreline to reach a depth of 4.8 feet of water when the lake level is at elevation <br /> 929.4 NGVD. � � � �`-� <br /> � � <br /> The dock depicted on the site plan proposed by the Applicant, which is attached at <br /> Attachment One and hereby made a part of these findings, will conform to side setback <br /> requirements along both sides of the dock use area for the Site. <br /> The Board finds that the shallow water at the Site is a hardship within the meaning of <br /> LMCD Coc��, 5�c�ti4�n 1.07 and that granting the variance requested on the conditions <br /> hereinafte�``'set forth, i�,��i,t�,sistent with the spirit and intent of the Code. <br /> ��3� '�, <br /> � �Y'� ORDER <br /> �� y�� <br /> ��, � <br /> �_�. �� <br /> ON THE���IS O��THE FOREGOING, IT IS ORDERED: <br /> �� <br /> � .�� ._ <br /> The a dock lengfh variance for construction of a dock extending 200 feet from the <br /> shoreline at elevatioriW929.4 NGVD is granted subject to the following conditions: <br /> a.
