The property is located in the LR-lA One Family Lakeshore Residential Zoning <br />District, which requires minimum lot area of 2.0 acres and minimum lot width of <br />200'. The lot contains 1.90 acres in area, and is 133' feet in defined width. <br />3. The applicant has proposed to construct a home that encroaches past the average <br />lakeshore setback line in order to minimize impacts on neighboring developed <br />residential properties. <br />4. The Orono Planning Commission last reviewed this application at a public hearing <br />held on February 21, 2006 and on a vote of 6-0 recommended approval of the <br />area/width and average setback variances subject to provision of suitable landscaping <br />and grading plans that would preserve as many existing trees on the site as possible <br />and mitigate sightline views for the neighboring properties. <br />5. Subsequent reviews by the City Council resulted in a series of plan revisions that <br />• culminated in the plans attached to this Resolution as Exhibits A, B and C which the <br />City Council finds conditionally acceptable based on the following findings: <br />a) The property contains an existing residence structure and detached garage. <br />b) The property is provided with municipal sewer. <br />c) The lot area of 1.90 acres and width of 133' is sufficient to allow construction <br />of a new residence on the site, where a residence has previously existed for <br />many years, without the need for any variances with the exception of an <br />average lakeshore setback variance. <br />d) Applicant has submitted building plans dated May 17, 2006 as well as a site <br />grading and drainage plan that confirm a new residence and attached garage <br />meeting all setback, hardcover, lot coverage, height and other standards ofthe <br />LR -1 A District (with the exception of an average lakeshore setback variance) <br />can be constructed on the property. <br />e) There is no land available for acquisition by the applicant to bring the lot into <br />conformity. <br />f) Granting of an average lakeshore setback variance is supported by the <br />following findings: <br />Page 2 of 6 <br />
