This is an accessory <br /> building serving as an additional dwelling on the property;the City considers this to be a"guest house".This guest <br /> house is one of two guest houses on the property in addition to the principal structure. Staff conducted a <br /> preliminary review based on the information provided and notes the following City Council approvals are required: <br /> 1. Conditional Use Permit. The original caretaker home predated the City's guest house regulations which <br /> requires City Council-issued conditional use permit (CUP). Because the new caretaker quarters/guest <br /> house is not being rebuilt in-kind a CUP is required at this time. City Code Section 78-303(2) regarding a <br /> guest house use and a Conditional Use Permit application are attached. <br /> 2. Variances. <br /> a. Average Lakeshore Setback - The guest house is located closer to the lake than the average <br /> lakeshore setback.According to City Code Section 78-1279(6), because the adjacent lakeshore lot <br /> on the west side of the property is vacant the setback is determined by the distance between the <br /> home to the east on 1100 Millston and Tanager Lake which is approximately 400 feet.An average <br /> lakeshore setback variance is required. <br /> b. Side Setback—Because of the guest house exceeds 1,000 square feet in footprint it is considered <br /> an oversized accessory structure (OAS). Over the years all of the oversized structures on the <br /> property either received approvals by the City or were acknowledged. Based on its size,the guest <br /> house must meet a 30 foot setback from the side property line. The attached deck shown does <br /> not meet the 30' side yard setback. You have the option of removing the deck, or redesigning it <br /> so it meets the 30-foot setback,or apply for a setback variance. <br /> The Code sections regarding OAS limits and average lakeshore setback are also enclosed for your reference.Also <br /> enclosed are the forms for the CUP and the Variance applications. Variance requests require demonstration of <br /> practical difficulty supporting the need for the variance(s). If you wish to meet with staff prior to submitting the <br /> application paperwork please let me know and we can schedule a meeting. The soonest deadline for application <br /> submittal is tomorrow, Wednesday,April 19th at noon.The next submittal deadline is on May 17t". Please note, <br /> we cannot issue a building permit for the guest house until the City Council grants CUP and variance approvals. <br /> We will combine the application fees;submit$700 for the CUP and variance(s). We currently hold a$2,500 escrow <br /> submitted with the building permit application. No additional escrow money is needed at this time. <br />
