The 2.52 acre portion of the Jacobs Property to be transferred to the Burwell Property is <br /> not intended to be a standalone building lot. Because this is a lot line rearrangement <br /> which results in no additional lots, no park fee or stormwater trunk fee will be required. <br /> 9. The following documents are known to be recorded against the Jacobs Property: <br /> a. Resolution No. 2897, regarding CUP and variance permitting a 1,749 s.f. guest <br /> house which will remain within the revised Jacobs property. <br /> b. Resolution No. 2907, regarding variances allowing a 2,604 s.f. greenhouse which <br /> will now be located within the revised Burwell property. <br /> c. Resolution No. 3320, regarding a CUP and variance to permit a 1,088 s.f. <br /> caretaker house (guest house) which will now be located within the revised <br /> Burwell property. <br /> d. Resolution No. 3428, regarding a variance to allow a 160 s.f. guardhouse which <br /> will remain within the revised Jacobs property. <br /> It is the intent of the City that the approvals and conditions of Resolutions No. 2907 and <br /> No. 3320 no longer be applicable to the revised Jacobs property, but remain in effect <br /> with respect to the revised Burwell property. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the <br /> findings noted above, the City Council of the City of Orono hereby grants the lot line <br /> rearrangement of the above referenced properties based on the lot line rearrangement survey <br /> dated 08/26/14 by Mark Gronberg of Gronberg & Associates, attached as Exhibit A; subject to <br /> the following conditions: <br /> 1. The 2.52 acre portion of the Jacobs Property to be transferred shall not be considered a <br /> standalone buildable lot, and shall be legally combined with the revised Burwell property. <br /> 2. The Applicant shall file the appropriate deeds reflecting the new legal descriptions <br /> (subject to City Attorney approval) with the Hennepin County Recorder's Office and/or <br /> Registrar of Titles Office on or before October 13, 2015, or the approval granted by this <br /> resolution shall expire. <br /> Page 3 of 4 <br />
