City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2552 <br />B) In reviewing the hardcover facts, the applicants have reduced <br />hardcover within the 0-75' and 75-250' setback zones with the <br />proposed improvement on the property: <br />0-75' Reduction of 6% <br />75-250' Reduction of 6% <br />C) The major addition to the existing structure will provide no <br />visual impact for the surrounding residential property because of <br />the location of the residential structure to the south and the <br />higher elevations of the property to the north. <br />D) The removal of major concrete- areas on the property and <br />replacing it with grass will provide a greater absorptive surface <br />for the run-off received from the north property and the property <br />to the south with excessive hardcover. <br />• 5. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicants and the effect of the proposed <br />variances on the health, safety and welfare of the community. <br />6. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variances would <br />not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve <br />as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the applicants; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.23, Subdivision 6 (B) <br />granting a 512" or 17% side setback variance; per Section 10.22, <br />Subdivision 1 grants a lakeshore setback variance of 58' or 77%; and per <br />Section 10.22, Subdivision 2 grants a hardcover variance within the 0-75' <br />lakeshore protected area of 1,973 s.f. or 21% for a proposed addition to <br />the existing structure, subject to the following conditions: <br />• 1. Applicants must obtain a permit from the County Highway Department <br />for the creation of a new curb cut. <br />Page 2 of 4 <br />
