I have r�evlewed the ma�rlals that <br /> you�provlded and I am confused as� why you are suggesting that I "appeal the <br /> language of the variance." <br /> it is�difFicult for me to understand why the Gty, af�r reviewing and approving <br /> the �uilding permit applicabon a�d the land alteratlon permlt appllcadon that <br /> were submitted and found to be in aocordance with the zoning ordinance and <br /> applcable varlance, has decld� to change its posi�on on the approval of the <br /> woric. <br /> As Isunderstand the hlstory of this sitie, in April, Z001, the property owner <br /> appied for the re-issuanoe of a varianoe that had init�ally been gr�nted in 1999. <br /> The►initlal variance granted �erbin exceptions from the C�ty's setback and <br /> hardcover ordinanoes. The Clty characterized the 2001 applitation as <br /> "reriew[ing] the variance as approved by the Councll on September 27, 1999." <br /> Through the variance, the City found that the"findings and condibions of <br /> Resmlution No, 4353 [were] stlll valld." The Clty approved the re-issuance of <br /> thls Narlance in May Z001. . <br /> Following this prooess, bullding permit applications and land alteration permit <br /> appllcations were submitbed bo the City for revlew. As you have no�ed, the <br /> survey that was submitbed with the perrnit appllca�ions, and revlewed by Clty <br /> staf�, delineates a biuff line that Is dlfferent than what you referenoe in your <br />
