� Sec./3.04 RIGHTSOFSUBlECTSOFDATA • � Subdivrsion I. Type ojdata The rights of individual on whom the data is stored or to be slored sha11 be as set forth in this section. . Subd 2. Injormation requtred to be given lndivtduaL An individual asked to supply private os confidential data concerning himself shall be informed o,r (a)the purpose and intended use of the requested data within the collecting stnte agency,political subdivrsion,or statewide system;(b)whether he may sefuse or is legally required to supply the requested data;(c)arry beown consequexce arising from his supplying or refusing lo supply prrvate or confidential data;and(d)the identity of other persons or entrties authorrzed by state or jederal law to receive Jhe data. This requirement sha[I not apply ivhen an individual rs asked to supp[y i�rvestigative data,pursuant to section 13.82, subdrvision S, to a!aw enforcemen!o�cer. The commissioner ofrevenue mav place the notice reauired under this subdivision in the individual income tax or nronerlv tax refund irestructions instead ot on those torms. Subd.3. Access to data by tndividuoL Upon request to a responsible auJhority,an rndividual shall be informed whether he is the subject of stored data on individuals,and whether it is classif:ed as public,private or confidentiaL Upon his further request,an irrdividual who is�he subjecJ of slored private or pablrc data on indivrduals shall be shown the data without arry charge to him and,if he desires,s/urll be informed of the content and meaning of that data. After an individual has been shown the private data and informed oJits meaning, the data need not be drsclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional datn on the individual has been collected or created. The responsible nuthority shall provide copies of the prrvate or public data upon request by the irrdividual subject oJ the data. The resporrsible authority may require the requestrng person to pay the actual costs of making,cert�rng,and compiling the copies. ' The responsible authority shal[comply immediately,if possible,with any request made pursuant to this subdivisron,or within frve days of the date orthe request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is no1 possible. I,f he cannot comply with rhe request within that time,he shall so injorm the individual,and may have an additional frve days within which to comply with the request,excluding Saturdays,Sundays and legal holidays. Subd 4.Procedure when data is not accurate or comple[�An individual may contest the accuracy or completeness ofpublic or private data concerning himse f To exercise this right, an individual shal!notify rn writing the responsible authority describing the nature of the • disagreement The resporrsible authority shall within 30 days either: (a)correct the datafound to be rrraccurate or incomplete and attempt to not� past secipients of ixaccurate or incomplete data,including recipiexts named by the individual;or(b)not�the individual that he believes the data to be correct. Data in dispute shal!be disclosed only if the indrvidual's statement of disagreement is included with the disclosed data. The determination of the responsible authority may be appealed pussuant to the provisions of the adminrstrative procedure act relating to contested cases.
