I compiled <br /> this from your survey, County piat drawings and our discussion last week to depict where you propose to place a <br /> gate system. <br /> I must advise you that after discussing the matter with the City Attorney, the City cannot allow the placement of a <br /> gate system at any location that would block the public's access to and across the various rights-of-way; i.e. a <br /> gate would not be allowed at location "A"where you propose it, and would not be allowed at"B"where we had <br /> suggested as a possibility last week. The City would not oppose a gate system within your property boundaries at <br /> locations "C" or"D", meeting the City's minimum standard of 5' setback into the property from your property line, <br /> and a horizontal opening not less than 14' wide with gates open. <br /> We understand that gates at locations "C" and/or"D" may not accomplish your goal. As an alternative, we <br /> strongly encourage you to consider placing a "private driveway— no outlet" sign at a location you and the City find <br /> mutually acceptable; I don't know whether the Railroad Authority or Hennepin County would allow such a sign on <br /> their respective right-of-ways. <br /> With respect to your request for verification that the driveway can remain in its current location, the City has no <br /> immediate plans to reconstruct the portion of Fox Street that abuts your home.
