! ` <br /> Sec.78-72.-Lots of record. <br /> {a) A lot of record is any lot for which a deed or registered land survey has been rec�rded in the affice of the register of <br /> deeds or the registrar of tides for Hennepin Caunty pMor to January 1,1975,and after approvai by the council if required. <br /> (b) A lot of record located withtn an R(Res�iential)or RR(Rural Residential)distriat but not within the Shoreland Overiay <br /> district, RS Seasonal Recreationai district, or any of the LR-Lakeshore Residential districts,which does not meet the <br /> requ�ements of this chapter as ta area or width may be utilized fw a single-family detached dweAing purpase,provided <br /> that in the judgmenf of the council or administrative a�roval by the plan�ing director, such use does not adversely <br /> affect pubilc health or safely and the foilowing requirements are met: <br /> (1) In R districts of one acre or less and served by public sanitary sewer. A lot o#'record extsting upon January 1, <br /> 1975* fn any R district of the aty of up to and inciuding one acre, which lot is servEced by public sanihary sew�er <br /> and which does not meet the requirements �thfs chapter as to area o�width only, may be utilized for single- <br /> family detached dwelting purposes without council approvai if all other requirements of the underlying zoning <br /> district are met, induding but not limited to requfr�yards, setbacks, lot c�verage by structures, t�rdcbver,etc. <br /> However,the!ot of record shall not be more irrtensely developed unless combined with one or mor�abutting lots <br /> o�portians so as to create a lot meeting the requirements of this chapter. <br /> {2) !n R or RR d+stricts af greater than one acre and served by public sanitary sev�r.A lot of record in any R or RR <br /> distirict in the city in exc�ss�'one acre wh�h does not meet the requirements of this chapter as to area or width <br /> only may be utilized far single-fam�y detached dwe��ing purpos� by administrative appnoval if the pianning <br /> directar flrxia that the followh�g conditions are met: <br /> a. It is at least one acre in size, and the average width af the lot is at least 100 feet; <br /> b. it is served by public sanitary sewer;and <br /> c. tt otherwise meets the requirements of this chapter ar other appiicabie Code�ovisions. <br /> (3) In R or RR distNcts not served by public sanitary sewer.A lot of record in any R or RR district in the city not <br /> served by public sanitary sewer must meet the arrya and width requirements of this chapter and shall not be <br /> utilized for singie-family detached dweNing purposes without councN approval. Administrative approval may <br /> be granted for a lot of record not meeting the lot area and wldth requirements tf the planning director find� <br /> that the foilawing conditions are met: <br /> a. The lot area and!ot width each meet at least 50 perc;ent af the district standard. <br /> b. Suitabie primary and altemate septic sites are ident�ed on the property and are protected from future <br /> development by execution of a cavenanf. <br /> c. All other zoning ordinance requirements must be met, including but not limited to the foilowing: <br /> 1. Setbacks. <br /> 2. Herdcaver. <br /> 3. Lot ooverage by structures. <br /> 4. Accessory structure requirements. <br /> {c) A lot of record located in any shoreland district, induding the Shareland Overlay district� RS Seasonai Recxeaponal <br /> distrrct, and any of the�R-Lakeshore Residerrtial district�,thai does not meeE the requirements of this chapter for lot <br /> size ar lot width shail be subject to the following regulations: <br /> (1) A nonconforming single Iot of recard may be allowed as a buliding site without variances from lot size and width <br /> requirements, prov�ded that: <br /> a. All setback requlremerrts can be met; <br /> b. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be installed or the <br /> lot is connected to a public sewer;and <br /> c. The impervious surFace coverage meets all hardcover location and square footage restrictions of this chapter <br /> and the tofal square footage of hardcover does nat exceed 25 percerrt of the errtfre lot area. <br /> d. All other zoning district standards can be met. <br /> (2) In a �oup of two or more contiguous lots of recorc! under a common awnership, an indhridual bt must be <br /> cansidered as a separate parcel ot' Iand for the purpose of sale or development, if it meets the fallowing ' <br /> requlrements: <br /> a. The tot must be at least 66 percent of the dimens'ional standard for lot width and lot size for the shoretarxf <br /> classification consistent with Minnesota Rules,chapter 6120; <br /> b. The lot must be connected to a public sewer, if available,or must be suitable for the instailation of a Ty� 1 <br /> sewage treatmertt system consistent with Minnesota Rules� chapter 7080, and Iocaf government controls; <br /> and <br /> c. Impervious surface coverage must meet ail hardc�ver locatian and square footage restrictions of this chapter <br /> and the ta�al square footage of hardoover must not exceed 25 perc:ent of the enare lot area;and <br /> d. Development of the lot must be consis#ent with the comprehensive plan. <br />
